Welcome to ZipZapZoi Eats. These Terms and Conditions ("Terms") govern your use of the ZipZapZoi Eats website, mobile application, and related services (collectively, the "Platform"). By accessing or using our Platform, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our services.
ZipZapZoi Eats is a global food delivery platform powered by artificial intelligence, connecting customers with restaurants and delivery partners. Our mission is to provide a seamless, efficient, and personalized food ordering experience. These Terms apply to all users of the Platform, including customers, restaurant partners, and delivery partners, unless otherwise specified in a separate agreement.
2. Account Registration
To use certain features of the Platform, you must register for an account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete.
- You must be at least 18 years old to create an account.
- You are responsible for safeguarding your password and for all activities that occur under your account.
- ZipZapZoi Eats reserves the right to suspend or terminate your account if any information provided proves to be inaccurate, not current, or incomplete.
Note: We use AI-driven identity verification to ensure the safety of our ecosystem. You may be asked to provide additional proof of identity.
3. Ordering & Payments
When you place an order through ZipZapZoi Eats, you are entering into a contract with the Restaurant Partner for the supply of goods. ZipZapZoi Eats acts as an agent to facilitate the transaction.
3.1 Pricing
Prices for menu items are displayed on the Platform and are subject to change. Additional fees, such as delivery fees, service fees, and small order fees, may apply and will be clearly displayed at checkout.
3.2 Cancellations
You may cancel an order within a limited time frame after placing it. Once the Restaurant Partner has accepted the order, cancellations may not be possible or may be subject to a cancellation fee up to the full value of the order.
4. Delivery Partner Terms
Delivery services are provided by independent third-party contractors ("Delivery Partners"). ZipZapZoi Eats facilitates the connection between you and the Delivery Partner but is not responsible for the actual delivery services unless explicitly stated.
Delivery times provided on the Platform are estimates only based on our AI logistics engine. Actual delivery times may vary due to traffic, weather, and restaurant preparation times. We are not liable for any delays that are beyond our reasonable control.
5. Intellectual Property
The Platform and its entire contents, features, and functionality (including but not limited to all information, software, text, displays, images, video, and audio, and the design, selection, and arrangement thereof) are owned by ZipZapZoi Eats, its licensors, or other providers of such material and are protected by copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.
You may use the Platform for your personal, non-commercial use only.
You must not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of the material on our Platform.
6. Liability & Indemnification
To the fullest extent permitted by law, ZipZapZoi Eats shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses.
You agree to defend, indemnify, and hold harmless ZipZapZoi Eats, its affiliates, licensors, and service providers, and its and their respective officers, directors, employees, contractors, agents, licensors, suppliers, successors, and assigns from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms.
7. Dispute Resolution
Any dispute arising out of or relating to these Terms or the Platform will be resolved through binding arbitration, rather than in court, except that you may assert claims in small claims court if your claims qualify.
The arbitration will be conducted by a neutral arbitrator in accordance with the rules of the Arbitration and Conciliation Act. The decision of the arbitrator will be final and binding.
